TERMS AND CONDITIONS

These Terms and Conditions govern all transportation services provided by Zenith Limousine Inc. (the “Company”).
By making a reservation through our website, the LimoAnywhere platform, by phone, or by email, the client (“you”) acknowledges that they have read, understood, and agreed to these Terms and Conditions, as well as our Privacy Policy, available at:

1. Reservations and Acceptance
All reservations made through our website, the LimoAnywhere platform, by phone, or by email are subject to vehicle availability and final acceptance by Zenith Limousine.
A reservation is considered confirmed only after written confirmation (email or system notification) has been issued by the Company.
Rates, availability, and vehicle categories provided at the time of request are for informational purposes only and may be modified prior to final confirmation.
Zenith Limousine reserves the right to refuse, cancel, or modify a reservation if:
the information provided is inaccurate, incomplete, or misleading;
the required payment or deposit is not received within the prescribed timeframe;
the request cannot be fulfilled for operational, regulatory, or safety reasons.
Any modification requested by the client after confirmation (schedule, itinerary, duration, or vehicle category) is subject to availability and may result in rate adjustments.
The vehicle provided will correspond to the reserved category. In the event of exceptional unavailability, the Company may provide an equivalent or higher-category vehicle, without this constituting grounds for compensation or claim.
2. Communications and Notifications by Email and SMS (IMPORTANT)
By making a reservation, the client expressly consents to receive transactional and operational communications by email and SMS, including but not limited to:
reservation confirmations;
service reminders;
operational notifications;
ride status updates (chauffeur assigned, en route, arrived on site, ride in progress, or completed).
SMS messages are sent from service numbers and are strictly limited to the execution of the reserved service. They do not constitute marketing or promotional communications.
The client is responsible for providing a valid and reachable phone number and acknowledges that SMS delivery cannot be guaranteed due to factors beyond the Company’s control (carrier, network coverage, device settings).
Communications may be transmitted directly or through third-party service providers used for technical and operational purposes.
2.1 Electronic Evidence
The client acknowledges that reservation confirmations, notifications, communication logs, electronic records, and data generated by Zenith Limousine’s systems, including the booking platform, constitute valid and admissible evidence and have the same legal value as written documents.
All matters relating to communications and the use of personal data are governed by the Privacy Policy, which forms an integral part of these Terms and Conditions.
3. Cancellation and No-Show Policy
All reference times are based on the local time zone of the pickup location.
Cancellation 24 hours or more prior to the scheduled pickup time → full refund, excluding non-refundable costs already incurred;
Cancellation less than 24 hours prior to pickup → 50% of the total amount charged;
Cancellation within 2 hours of pickup → 100% charged (non-refundable).
No-show: failure of the client to appear after the applicable waiting time → 100% charged.
For clarity, the applicable waiting time is defined in Section 4 (Waiting Time Policy), including airport and non-airport pickups.
Any material modification (date, time, or location) may be treated as a cancellation, at the Company’s discretion.
Exceptional circumstances may be reviewed at management’s sole discretion.
All cancellations or modifications must be communicated by phone or email and confirmed by the Company.
4. Waiting Time Policy
Waiting time is calculated from the scheduled pickup time stated on the confirmation or, for airport pickups, from the actual flight landing time based on official flight tracking systems.
4.1 Airport Pickups
Grace Period:
60 minutes for international flights
45 minutes for domestic flights
After the grace period:
First 30 minutes: CAD $30
Each additional 15-minute increment: CAD $15
4.2 Non-Airport Pickups
Grace Period: 15 minutes
After the grace period:
First 15 minutes: CAD $15
Each additional 15-minute increment: CAD $15
4.3 Hourly Services
Waiting time is included within the reserved duration. Any extension is billed as overtime.
4.4 Special Events
Included waiting time is specified in the reserved package.
Any excess is billed at CAD $30 per 15-minute increment.
4.5 General Provisions
Waiting time charges are added to the final invoice.
The Company reserves the right to release the vehicle after an extended waiting period, without guaranteeing further availability.
4.6 Flight Information
The client is responsible for providing accurate, complete, and up-to-date flight information.
Zenith Limousine shall not be held liable for delays, waiting charges, or no-shows resulting from incorrect or outdated flight details.
5. Payments, Deposits, Additional Charges, and Overtime
All rates are expressed in Canadian dollars (CAD) and exclude applicable taxes, gratuities, and additional charges.
5.1 Deposits and Payments
All deposits are non-refundable, unless otherwise stated in writing.
The full balance must be paid before or at the start of the service, unless otherwise agreed in writing.
The Company may perform a pre-authorization or capture additional amounts as required.
5.2 Additional Charges
The client authorizes billing for additional charges including, but not limited to: waiting time, overtime, unscheduled stops, service modifications, tolls, parking, and other operational expenses.
5.3 Overtime
Any overtime is billed in 15-minute increments, rounded up to the next increment.
5.4 Payment Default
Any declined payment or unjustified chargeback remains the client’s responsibility, including administrative and collection fees.
5.5 Stored Credit Card
Storing a credit card in the reservation system (including LimoAnywhere) constitutes an express and ongoing authorization to charge the card before, during, or after the service for any amount due under these Terms and Conditions.
Zenith Limousine uses only secure, compliant payment processors and does not store full credit card details.
5.6 Gratuities
Gratuities are not included unless expressly stated otherwise.
An automatic gratuity may apply to certain services or corporate bookings and will be clearly disclosed.
6. Client and Passenger Responsibilities / Damages
6.1 General Responsibility
The client is responsible for their conduct and that of all passengers.
6.2 Vehicle Damage
The client assumes full financial responsibility for any damage to the vehicle, including but not limited to burns, tears, excessive soiling, equipment damage, or contamination.
6.3 Actual Cost
Charges reflect the actual cost of repair, cleaning, or replacement, including labor, parts, and any vehicle downtime or loss of use, with no predefined cap.
6.4 Post-Service Billing
The client authorizes Zenith Limousine to bill such charges after the service using the payment method on file.
6.5 Safety
Any illegal, dangerous, or abusive behavior authorizes the chauffeur to immediately terminate the service without refund.
6.6 Zero-Tolerance Policy
Any abusive, aggressive, threatening, or discriminatory behavior will result in immediate service termination without refund and may be reported to the appropriate authorities.
Standing up or using the sunroof while the vehicle is in motion is strictly prohibited.
7. Liability, Delays, Safety, and Force Majeure
Zenith Limousine does not guarantee any specific arrival time. All schedules and durations are estimates only.
The Company shall not be held liable for delays or interruptions resulting from traffic, weather or winter conditions, accidents, mechanical issues, flight delays or changes, governmental directives, or force majeure events.
Zenith Limousine will make reasonable efforts to mitigate the impact of such events where operationally possible.
The chauffeur reserves the right to modify the route, refuse unsafe instructions, or interrupt the service for safety or legal compliance reasons.
The maximum liability of Zenith Limousine, if any, is strictly limited to the amount actually paid for the service concerned.
No indirect or consequential damages (missed flights, financial loss, lost opportunities) may be claimed.
8. Lost or Forgotten Items
Zenith Limousine is not responsible for items lost, forgotten, or left in the vehicles.
No obligation of search, storage, or safekeeping is assumed.
Any recovery or shipping costs are the client’s responsibility.
No liability is assumed for valuables.
9. Capacity, Safety, and Legal Compliance
The client must comply with the legal passenger and luggage capacity of the vehicle.
Seat belts and child safety seats are mandatory as required by law.
The Company may refuse, delay, or terminate the service without refund in case of non-compliance.
Alternative solutions may be offered subject to availability and additional charges.
10. Privacy and Data Protection
The Privacy Policy of Zenith Limousine forms an integral part of these Terms and Conditions.
By making a reservation, the client acknowledges having reviewed this policy and agrees to the use of personal data, including email and SMS communications and the involvement of third-party service providers for operational purposes.
Personal data is handled in accordance with applicable Québec and Canadian privacy laws.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Province of Québec and the applicable laws of Canada, excluding conflict-of-law rules.
Any dispute shall fall under the exclusive jurisdiction of the courts of the judicial district of Montréal, Province of Québec, Canada.
The French version shall prevail for interpretation purposes, unless otherwise required by law.
12. Severability
If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
